Biotute Terms and Conditions

Biotute is the trading name of Sara Porter of 27 Collumbell Avenue, Ockbrook, DE72 3TF, and provides private online tuition in Biology and Science. These are the terms and conditions on which Biotute agrees to work with you. By booking and proceeding with Biotute’s services you are agreeing to these terms and conditions so please read them carefully before you book.

In this document and on our website, ‘we’, ‘us’ and ‘our’ mean Biotute while ‘you’ and ‘your’ mean the person(s) engaging Biotute’s services. ‘Services’ means the work you’re engaging Biotute to do; biology and science tutoring. Similarly, the terms ‘tutoring’, ‘support’, ‘work’, ‘products’ and ‘packages’ refer to the tutoring services we offer or provide. ‘Session fee’ means the money paid in advance for each lesson or package.

These terms and conditions were written in August 2020. We will review them periodically and update them to reflect any changes in our business. Where we make changes that significantly affect current students, we will let you know through the most appropriate means of communication.

The agreement between us is governed by English law.

1.0 Using our website
Users are each responsible for their own security when using our website, when this becomes operational.

2.0 Engaging Our services
Where a student is under the age of 18, we require consent from a parent or legal guardian in order for them to book and receive tuition from Biotute.

3.0 Payment
Lessons will be charged at our current prices, as confirmed with you when making your booking. The first lesson is a free trial but for all subsequent lessons payment must be made in advance to secure the booking. Payment may be made by bank transfer or using STRIPE and any refunds due will be made via the original payment method.

4.0 Our Responsibilities
Once you have engaged our services, we will provide you with tutoring as agreed between us. We agree to provide our services diligently and punctually, with due skill, care and attention at all times. You agree to pay in advance all amounts due for each booking, and to give the required notice as set out below in the event of any changes or cancellations. As Biotute is a fully inclusive service with tuition and support designed to fit each student’s needs and way of working, you also agree to provide us with any relevant information to enable us to deliver our service in the most effective way.

5.0 Student Responsibilities
We expect students to show commitment to their studies, to be correctly prepared and equipped for each session and to be punctual. Many of Biotute’s sessions are booked back to back and it will not normally be possible to overrun at the end of a session to make up time. Where the start of a session is delayed because you are late, we will not refund any portion of the session fee. It is the student’s responsibility to ensure that homework is complete a minimum of two days before the date of each session so that Biotute can carry out marking and give feedback.

6.0 Confidentiality and Privacy
Our privacy policy explains how we use personal data and comply with data protection law. We will send a copy of this to you when you make your first booking. Please read it carefully. Both you and we agree to respect the privacy and confidentiality of the other party, during the tutoring relationship and afterwards.

7.0 Safeguarding
Biotute has enhanced DBS clearance and undertakes safeguarding training. Please note that we have a legal obligation to pass concerns to the correct authorities if certain safeguarding issues are disclosed in the course of tutoring.
8.0 Absence and Cancellation Policy
In the event that Biotute is unable to provide a booked session, we will provide as much notice as possible and automatically move the lesson to a new, mutually convenient date. Where no suitable date can be found and you wish to cancel the session, we will refund the session fee.

Once booked, package dates are fixed and may only be moved in the following circumstances and with a minimum of 24 hours’ notice: illness, family illness, exams, university interviews or driving exams. If you give less than 24 hours’ notice, rearrangement of a session is at the discretion of Biotute. If the lack of notice means we cannot move your session to another date and it needs to be cancelled, we will not refund the session fee except in an isolated case of sudden illness.

If you wish to cancel a session without rearranging, we require 48 hours’ notice. If you do not give the required notice, the session fee will not be refunded.

9.0 Termination
This agreement may be terminated at any time by either party for any reason, subject to 7 calendar days’ notice in writing. Upon termination, Biotute will delete all student data (except as set out in our privacy policy) and will refund any outstanding payment back to the payee. If you do not provide the required notice, Biotute will not refund session fees for the remainder of your booked package.

The 7-day notice period does not apply in relation to the initial free trial lesson, which carries with it no obligation to take further sessions.

Biotute reserves the right to terminate the agreement with no notice for the following reasons: unacceptable conduct by the student or their parent/guardian, irrevocable breakdown of the student/tutor relationship, or breach of these terms of conditions. In this event, we will not refund any outstanding fees.

10.0 Pricing
We reserve the right to change our pricing at any time. We will aim to keep the prices on our website up to date and to give current students reasonable notice of any changes.

11.0 Plagiarism
Plagiarism is a serious issue which can result in qualifications being withdrawn. Biotute will not complete work for students to pass off as their own. Where assistance is provided with assignments or other school coursework, the student must ensure they appropriately acknowledge and reference this in the work.

12.0 Intellectual Property
We provide each student with personalised resources. All resources, and all content on our website, remain the intellectual property of Biotute. Students are entitled to keep their resources for personal study and use but must not post them on social media, share them with others in any format or resell them. We reserve the right to take appropriate action in the event of any misuse of our intellectual property.

13.0 Limitation of Liability
We will deliver our services with skill, care and diligence and aim to ensure students make satisfactory progress, but we cannot be held accountable for the academic success or otherwise of any student. To the extent permitted by law, we do not accept liability for any direct or indirect loss or damage arising from the use of our services, the use of our website or any errors or omissions in the content of our teaching materials and resources.

14.0 Complaints
We hope you will be happy with our services, but if you have any concerns or complaints please raise them with us straight away so we can resolve them promptly and amicably
